Injury At Menards Equals CASH For Area Woman.
Opinions here will really depend where you land in a story like this- are you the business owner? Just a defendant not wanting to get your pants sued off. Or, are you the plaintiff looking to "fall" into some cash?
AP News is reporting that Darlene Johnson was awarded $40,000 for injuries sustained at the Menards store in Minot. $40,000 is a pretty nice chunk of change, but far from the millions awarded for far less severe injuries. According to the story, Darlene tripped on a flatbed cart and according to the Minot Daily News, smashed her face but good.
Johnson cracked seven teeth which required extensive dental work, including root canals and bridges.
Gravity can be a real b*tch sometimes.
So $40,000 for some expensive dental work and a ton of pain and suffering doesn't seem excessive at all. But, Menards is appealing the jury award. Seems petty to me as I don't see where Ms. Johnson is being at all excessive with her demands.
HER LAWYERS ON THE OTHER HAND!
ONE HUNDRED AND FORTY FIVE THOUSAND DOLLARS IN ATTORNEY'S FEES!!
How can that even be a real thing? Isn't is usually a cut of the plaintiff's award? I mean Ms. Johnson wasn't so greedy as to overstep what she must have thought was "fair compensation" for the incident. It would seem her lawyers are putting her in danger of losing during an appeal.
This isn't a condemnation of all lawyers. I have family and friends that are both attorneys and swell people. So, good luck Darlene- hope your face is feeling better. As for your lawyers? They can go kiss a duck.
