4th of July Fireworks Laws For Bismarck-Mandan

With the 4th coming up,  your seeing the tents popping up in the usual places and now it's time to review the ordinances for celebrating with fireworks in the area.

According to the City of Bismarck Official Website,

 "The sale, possession or discharge of fireworks within the City of Bismarck is prohibited, and violators could be charged with a class B misdemeanor punishable by up to 30 days in jail and/or fined up to one thousand dollars.”

In detail, the fireworks that are prohibited are anything sold at a fireworks stand, which has to be ignited. This does include snakes and sparklers.  Caps, for a cap gun, on the other hand are not prohibited. Call Sergeant Mark Buschena, 355-1874 with any additional questions.

In Mandan, according to the City of Mandan website-

The possession, use, discharge, or explosion of fireworks, not including bottle rockets, is permitted between the hours of noon and 12 a.m. on July 2-3, and from the hours of noon on July 4, to 2 a.m. on July 5, of each year.  Violations are punishable by a fine of $75. Bottle rockets are prohibited from use in the City of Mandan.

For Morton County- Unless otherwise posted, the use of fireworks in the unincorporated areas of Morton County is allowed until 11:00 pm on June 27 to July 3, and July 5.  On July 4, the use of fireworks is allowed until 2:00 am (on the morning of July 5).  Fireworks are not allowed in Morton County Parks or ND Game and Fish Wildlife Management Areas.

According to the Burleigh Country Website concerning fireworks for Lincoln-

The use of fireworks within the corporate limits of the City is allowed from July 1-5.  Time of use shall be limited to between the hours of 12:00 p.m. until 10:00 p.m. on July 1, 2, and 5 and from 12:00 p.m. until 1:00 a.m. on July 3 and 4.  A law enforcement officer may take into their possession any fireworks found in violation.  No child under the age of eight shall use any fireworks without the direct supervision of another person sixteen years of age or older.  Violation shall be considered an offense, for which a fine of not more than $1,000, or imprisonment not to exceed 30 days, or both, may be imposed.

For the county- No restrictions; however, if the fireworks cause damage, the citizen can be can be criminally liable as well as civilly liable for damages.
